(1) These General Terms and Conditions (hereinafter "Terms") of Delina GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods presented by the Seller in its online shop.
(2) Deviating, conflicting, or supplementary general terms and conditions of the Customer shall only become part of the contract if and to the extent that the Seller has expressly agreed to their validity.
(1) The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but serve to enable the Customer to submit a binding offer.
(2) The Customer may submit the offer via the online order form integrated into the Seller's online shop. After placing the selected goods in the virtual shopping cart and going through the electronic ordering process, the Customer submits a legally binding contractual offer for the goods contained in the shopping cart by clicking the button that concludes the ordering process.
(3) The Seller may accept the Customer's offer within five days by sending the Customer a written order confirmation or an order confirmation in text form (fax or email), or by delivering the ordered goods to the Customer.
(1) The prices stated in the respective offers of the Seller include statutory VAT plus the respective shipping costs.

(3) If payment by invoice has been agreed, the purchase price is due without deduction within 14 days of receipt of the goods and the invoice.
(1) Goods are delivered by shipping to the delivery address specified by the Customer, unless otherwise agreed.
(2) Shipping costs within Germany are a flat rate of EUR 3.95. We ship free of charge for orders of EUR 40.00 or more.
(3) Delivery time within Germany is generally 2-4 business days, unless otherwise stated.
The delivered goods remain the property of the Seller until the purchase price owed has been paid in full.
(1) If the delivered item is defective, the statutory provisions on liability for defects shall apply.
(2) For consumers, the limitation period for defect claims relating to movable items is two years from delivery of the goods.
(3) The above provisions do not alter the burden of proof to the detriment of the Customer.
(1) The Seller shall be liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty by the Seller or its legal representatives or vicarious agents.
(2) For other damages, the Seller is only liable in the event of a breach of a material contractual obligation, the fulfillment of which is essential for the proper performance of the contract and on the observance of which the Customer may regularly rely (cardinal obligation), but limited to the foreseeable damage typical for this type of contract.
(3) Otherwise, liability is excluded.
The Seller collects and processes the Customer's personal data only within the scope of applicable data protection regulations. Further information, in particular on the purposes and scope of data collection and processing as well as the Customer's rights, can be found in the Seller's privacy policy, which is available on the Seller's website.
(1) Contracts between the Seller and the Customer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Seller shall be the Seller's registered office.
(3) Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
